The Western Shop Terms & Conditions
“The Western Shop” “TWS” and www.thewesternshop.com are trading names or brands of ‘The Western Shop’ registered office & Postal Address: The Western Shop, C/O 31 Greenside Close, Clowne, Chesterfield, Derbyshire. Acceptance
When you make a purchase from us via our website, www.thewesternshop.com you indicate that you agree to be bound by our Terms & Conditions. However your statutory rights are not affected. Please read our Terms & Conditions carefully and we recommend that you print and retain a copy for your records. We reserve the right to, at any time, revise our terms and conditions should it become necessary to do so and without notice, but any such revisals do not apply to any purchases you have already made with us. We therefore advise that you review the terms and conditions regularly before each purchase.
Delivery
We Ship to the UK, Republic of Ireland and the Europe with our standard rates.
We do ship Internationally. Please contact us directly for a shipping quotation.
We endeavour to deliver within 48 hours (Mainland UK & working days only) of you receiving our DISPATCH NOTICE (usually via email) All deliveries will be made to the shipping address provided by the customer. At times of exceptional demand or when outside of our control delivery issues may occur this may extend the delivery timescale.
Courier Deliveries:
A signature will only be required upon delivery, for high value items (we will advise you if a signature is required).
All parcels from The Western Shop are tracked by us and delivery notification and location is relayed to us via our courier.
Delivery will be made by UK Mail Courier Service or their authorized subsidiaries.
Mainland UK Deliveries are charged by price:
0 - £25.00 = £ 3.50 or £4.99
£25.01 - £99.99 - £4.99
£150.00 upwards – Free Shipping
Republic of Ireland - £15.00
Europe - £25.00
Royal Mail Deliveries:
Deliveries with a value LOWER than £25.00 can be made by Royal Mail but this falls outside of the 48hr delivery timescale. Royal Mail Deliveries will be charged at £3.95p.
We endeavour to make every effort to carry all items in stock for prompt dispatch but as orders are dispatched that the item you require may go Out Of Stock from time to time.
We will endeavour to contact you within 48 hours with a revised delivery date where possible. We cannot be held responsible for compensating you for any loss you may suffer if we do not supply the goods. We reserve the right to refuse or cancel an order for goods if it has been listed at an incorrect price due to a typographical error or the price from our suppliers, tax or duty office was incorrect when our price was published.
We reserve the right to charge an additional postage cost if incurred due to the customer not choosing the correct location for delivery or ordering the incorrect size or colour. We cannot guarantee a time of delivery but will endeavour you receive your delivery as quickly and efficiently as possible. It is the customers responsibility to arrange collection of the goods should they miss the first attempt. If delivery advice is not offered and delivery or your order is missed we reserve the right to charge any costs incurred to The Western Shop for repeated delivery attempts and for parcels returned to us.
The Western Shop cannot be held responsible for non-receipt of items where the customer has entered the wrong delivery details.
All prices shown on www.thewesternshop.com are, where applicable, inclusive of VAT and are shown in pounds sterling. Delivery charges will be shown separately during the order process.
All products and services offered for sale on this website are subject to availability and may be withdrawn at any time. Pictures are used for illustration purposes only, although we endeavour to be as accurate as possible, may differ slightly from the actual product supplied. If goods cannot be supplied for any reason we will contact you and you will not be charged for the items ordered. If payment has already been taken, you will be refunded for the cost (and any postage charges if applicable) immediately.
Bulky Items, Delivery and Returns
We will advise you of delivery costs (should your delivery exceed 25 kilos). Due to the nature of these items we will endeavour to contact you prior to delivery.
Special Order & Bespoke Orders
Orders for special order goods or Bespoke Items - items not normally kept in stock may not be cancelled. Items must be paid for in full prior to ordering.
Goods Damaged or Faulty in transit
On signing for your delivery, please ensure you check you have received the correct number of parcels and that you make a note of any apparent damage to any of the parcels. This must be noted in your consignment note. Ensure your parcels are opened immediately and carefully check the contents as you must inform us within 3 days of any damage or discrepancy.
Goods Lost in transit
The Western Shop will accept no responsibility for returned goods lost in transit. We will endeavour to help locate deliveries from ourselves that may get lost in Transit. Please notify us immediately if you do not receive your package within 72 hours of Dispatch Notification.
Returns Policy
In accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, as amended, you are entitled to cancel your order at any time within 14 days of receiving your goods. Full information about The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 can be found at:- http://www.legislation.gov.uk/uksi/2013/3134/made or you can obtain advice from the Citizens Advice Bureau or similar organisations.
You have the right, in terms of these Regulations, to cancel your contract with us within 14 days of your receipt of the goods, or receipt of the last item in the event that the contract relates to more than one item, without giving us any reason. You must inform The Western Shop of your decision to cancel the contract. You can do this by a simple statement telling us you are cancelling the order, sent to us by post or email identifying the goods and the date they were ordered or received (also providing us with the Invoice Number is helpful but is not obligatory) and this must be done before the 14 day cancellation period expires. If possible please also phone us to discuss the return as this can speed up the process. If you cancel your contract with us, we will reimburse to you all payments received from you, including the costs of delivery (but not the cost of any type of delivery other than the least expensive type of standard delivery offered by us). Goods should be returned with their labels left on, in their original packaging and in an unused & undamaged condition with proof of purchase so they are fit for resale; you must return the goods within 14 days of the date when you have informed us of cancellation of the contract, and the cost of returning the goods in terms of this clause is your responsibility, please package returned goods carefully to avoid damage in transit and we recommend that a recorded delivery/insured postage method of carriage should be used as we accept no responsibility for goods not returned to us. We may make a reasonable deduction from the reimbursement for any loss in value of any goods you return if the loss is the result of unnecessary handling by you or damage while in your control. We will make the reimbursement to you without undue delay and within 14 days of return of the goods forming the cancelled contract; the reimbursement will be made using the same means of payment as you used for the initial transaction, or such other means as you and we expressly agree, but in any event without us charging any fees or making any deductions other than as detailed above from the reimbursement.
Your right to cancel the contract and return items in terms of this Returns Policy does not apply in respect of (a) any item made to your specifications or personalised for you, (b) sealed audio or video recordings (CD’s, DVD’s and the like) which have become unsealed after delivery to you, and (c) sealed goods which are not suitable for return due to health protection or hygiene reasons, if they become unsealed after delivery to you.
Faulty/damaged Goods
Once an item has been worn or used it cannot be returned unless the item is found, by the manufacturer or the Western Shop, to have a fault. Under no circumstances should any goods damaged or faulty through poor workmanship or materials continue to be used. In these circumstances items may have to be sent to the manufacturer for testing so please allow 30 days for this process as some manufacturers are based overseas. This does not affect your statutory rights.
Incorrect Items sent
In the unlikely event that we make an error and the item received is not the item(s) ordered by you, we will offer you a replacement or a full refund. You must contact us straight away via email or letter to advise of the error, and in such circumstances the Western Shop will arrange with you for return of the item at our cost. Please note that replacements can only be sent once the original item has been returned to us.
Exchanges
In addition to the foregoing and your statutory rights, we are also willing to exchange unused items returned to us within 30 days of purchase (i.e. the date you receive the item(s)). We will post to you, or you may collect, replacements on receipt of the original goods in perfect condition, with all labels on and in original packaging. It is recommended you obtain a certificate of postage/recorded delivery with adequate insurance from the post office if making a return, to enable you to make a claim for any damage. We will be unable to compensate for items returned for exchange that are lost or damaged in transit. Customers wishing to exchange items will be required to cover all postage costs. Please contact us by phone or email if wishing to exchange items.
Buying a Product
When you buy a product by utilising the functionality built within our website on the internet, we do not store any of your financial information (such as credit card details) on the website, these are all processed securely off site with our primary payment handler.
The Western Shop and www.thewesternshop.com is a PCI DSS Compliant Store.
Log-In & Registering
Logging in to the store allows you to keep track of your orders, previous orders and save address details, this is a mandatory function of the site.
By registering and logging into The Western Shop you also have the option to include your email address on our mailing list, please be assured that this will never be sold or passed to third parties. You may unsubscribe at any time.
Warranty Information
Most items appearing on www.thewesternshop.com have a manufacturer’s warranty which is passed directly to the customer. The Western Shop has no control over the terms of the manufacturer’s warranty, but your Statutory Rights are unaffected by the same. If your product is faulty or damaged on delivery, or later develops a fault, please refer to the “Faulty/damaged Goods” sections.

Please note that you use this website entirely at your own risk. We cannot accept any responsibility for disruption, damage or loss of data on your computer system which occurs during or because of the use of the www.thewesternshop.com website. We will try to offer you helpful and honest advice but the decision to purchase, lies ultimately with the customer. In no way can we be held responsible for any consequences relating to any products purchased from the website.

Jurisdiction
All contracts with The Western Shop are governed by and constituted in terms of English Law, except where the customer is a private individual who is resident in another constituent country of the U.K. in which case they may elect to have the law of that country applied to the contract, and all contracts are subject to the exclusive jurisdiction of the English Courts or the courts of such other constituent country of the U.K. if so elected.
